REVISED GUIDELINES FOR THE FUNCTIONING OF INDUSTRIAL
AREA LOCAL AUTHORITIES (IALAs) AND SERVICE SOCIETIES
(with Amendments)

APIIC-LAC- Revised guidelines on the functioning of MIAs and Service Societies issued and communicated to all 2Ms/Commissioners/Eos in the state vide Circular dt. 1 0. 1 0. 201 3.

I.Preamble:

The local body functions within an Industrial Park/ Industrial Estate/ Special Economic Zones established by APZIC are being performed by IALAs. The IALAs are exercising the functions of a Municipal Corporation / Municipality/ Grampanchayat with a condition that 35% or 50% of the property tax collected is remitted to the parent local body.

To promote the practice of self-governance, societies has been introduced by involving the industrial units located in the Industrial Parks in various management aspects. In view of the practical experience of the last many years, it is necessary to modify some of the guidelines.

II.Role of APIIC:

organised in the form of Zonal Offices which are headed by Zonal Managers, The activities of al? the Zonal Offices are coordinated from the APIIC Head Office which is headed by the Managing Director. APIIC Head Office plays the following role with regard to.IALAs and Service Societies.

  1. Appointment of Commissioner/ Executive Officer for each MLA with the powers to transfer based on administrative necessity
  2. To take disciplinary action against any Commissioner/ E.O. for any irregularity or breach of law.
  3. To overrule any decision taken by IALA / Service Society if it is be against existing law/ rules or if it violates any established procedure.
  4. To provide directions/ guidance to IALAs/ Service Societies for taking up any new initiative meant for industrial development.
  5. To provide funding support to the IALAs/ Service Societies for taking. up any priority work as per mutual agreement.
III.Role of Nodal fficer:

APIIC has appointed Senior Officers of Head Office as Nodal Officers Cc!) one for each zone. The Nodal Officers should review the functioning of each IALA during their inspection visits to the zone and offer their remarks with a copy to the Zonal Manager, Commissioner/ EO and Chairman of the Service Society so that immediate remedial action, if any, can be taken.

IV. Role of Zonal Mananger
  1. Zonal Manger shall supervise, review, guide and advise overall functioning of the IALA and Service Society.
  2. Zonal Manager is responsible accounting of the revenues generated by IALA and the expenditure incurred.
  3. Zonal Manager will monitor the transfer of the due share of 'ALA revenue to the respective local body.
  4. Election Officer for conducting elections to the Service Societies and supervise the conduct of elections.
  5. Zonal Manager will recommend the proposals for nomination as well as withdrawal of the Service Societies
  6. Zonal Manager will maintain an Enforcement Cell which will assistance to IALAsi Service Societies for protection of removal of encroachments etc.
  7. Zonal Manager will conduct review meeting of all IALAs and service societies in his jurisdiction once every quarter on a fixed date.
  8. Tenders shall be called on yearly basis for maintenance works such as garbage lifting / sweeping / streetlights.
V. Role of Commissioner / Executive Officer.
  1. Commissioner/ Executive Officer is responsible maintenance of all civic services in IALA area.
  2. Commissioner/ EO is the competent authority for approval of building plans, assessment, levy and collection of property taxes as per the existing Government Orders.
  3. Commissioner/ EO is responsible for maintenance of all records for the IALAs and service societies as prescribed by APIIC.
  4. Commissioner/ E0 is responsible for furnishing periodical reports to Zonal Office/ Head Office as prescribed.
  5. Commissioner/ E0 will be the convenor for all meetings of the service societies namely EC meeting, general body meeting and sub-committee meetings. It is his responsibility to ensure that the minutes of these meetings are correctly recorded and circulated to all the members.
    Certain amendment / modification issued against the Clause No. (V) of (5) on the role of Commissioners / Executive Officers vide circular, APIIC/ IALA/ HO/Guidelines/ 2013 206, dt.10.5.2014, regarding conducting service societies meetings and the communication of the minutes to the concerned, since the Commissioner has no role ,as per the bye laws of the Service Society registered with the Registrar of Societies as follows.
    The Secretary of the Service Society concerned will be th e Convener to all the meetings of the Service Society viz. , EC Meetings, General Body Meeting an d sub - committee meetings. It is the responsibility of the Commissioner/Executive officer to ensure that the min utes of the meeting duly countersigned are communica ted to Head office, members of the Service Society and the members of the respective Committees, for further necessary action
  6. Commissioner/ EO will be the PIO under the provisions of RTI Act and Rules for the IALA area.
  7. The Commissioner/ EO wiil be responsible for implementing the citizens charteras prescribed.
  8. The Commissioner / E0 should furnish building plan approval details to the Managing Committee.
  9. Commissioner should ensure that trade licence is issued to each industry.
  10. The commissioner should enter into MOU with Local Body concerned regarding (i) providing trunk infrastructure i.e, lifting of garbage collection, sharing of central / state government grants.
VI.Structure of the Service Social

The Service Society will comprise of all the industrial units which have been formally allotted plot by APIIC within the limits of the Industrial Park/ Industrial Estate/ SEZ. The service society will elect Managing Committee having 5 office bearers namely.

EXPLANATORY MEMORANDUM AS TO THE ACTION TAKEN ON THE RECOMMENDATIONS MADE BY THE FIFTEENTH FINANCE COMMISSION IN ITS FINAL REPORT SUBMITTED TO THE PRESIDENT ON NOVEMBER 9, 2020.
  1. The Fifteenth Finance Commission (XV-FC) [Commission, henceforth] was constituted on 27th November 2017 by the President, vide Order number S.O. 3755(E) dated 27th November 2017. The Commission, vide S.O. No.4308 (E) dated 29th November, 2019, was mandated to submit two reports i.e. a first report for financial year 2020-21 and a final report for the period 2021-22 to 2025-26. The Commission submitted its first report covering the financial year 2020-21 to the President on 5th December 2019 and an Explanatory Memorandum on the Action taken was presented to Parliament on 1st February 2020.
  2. The Final Report of the Commission covering the financial years 2021-22 to 2025-26 commencing from April 1st, 2021, together with this Explanatory Memorandum on the action taken on the recommendations of the Commission, is being laid on the Table of the House, in pursuance of Article 281 of the Constitution. Summary of the main recommendations related to sharing of the Net proceeds of Union taxes between the Centre and the States, grants-in-aid of revenue of States under Art 275(1) of the Constitution, financing of relief expenditure, grants to local bodies and other recommendations are contained in this Memorandum. This Memorandum also contains the recommendations related to Sectoral Grants, State Specific Grants and fiscal path as contained in the Report submitted by the Commission to the President on November 9th 2020.
  3. Sharing of Union Taxes.

  4. The Commission has recommended that 41 per cent of the net proceeds of Union taxes should be shared with the States as against the present 42%. The Commission felt that, financial resources equivalent to 1% of the net proceeds of Union taxes should be retained with the Central Government for financing the requirements of the newly formed Union Territories of Jammu & Kashmir and Ladakh.
  5. The Government has accepted the above recommendation of the Commission.
    Grants-in-aid of Revenues of States under Article 275 of the Constitution
  6. The Commission has recommended Grants-in-aid of revenues of States for revenue deficit, local bodies, disaster management, sector-specific and certain state specific under Art 275 of the Constitution.
  7. Revenue Deficit Grants
  8. The Commission has recommended Post-devolution Revenue Deficit Grants amounting to Rs.2,94,514 crore for seventeen States over 2021-22 to 2025-26. The number of States qualifying for the revenue deficit grants decrease from seventeen (17) in 2021-22, the first year of the award period to six (6) in 2025-26, the last year of the award period. Over the five-year period Andhra Pradesh, Assam, Haryana, Himachal Pradesh, Karnataka, Kerala, Manipur, Meghalaya, Mizoram, Nagaland, Punjab, Rajasthan, Sikkim, Tamil Nadu, Tripura, Uttarakhand and West Bengal are being recommended to be provided the deficit grants in one year or the other. The details of the revenue deficit grants and the manner of providing them are contained in paras 10.11 to 10.19 and Tables 10.2, 10.3 and 10.4 of Chapter 10 of Volume–I of the Final Report.
  9. The Government has accepted the above recommendations of the Commission.

    Local Bodies Grants

  10. The Commission has recommended total grants for duly constituted local governments that add up to Rs. 4,36,361 crore for the period 2021-26. The Commission has recommended basing the inter-se distribution of grants for local bodies among the States, on population and area in the ratio of 90:10.
  11. A sum of Rs. 2,36,805 crore is earmarked for rural local bodies, Rs.1,21,055 crore for urban local bodies and Rs. 70,051 crore for health grants through local governments. Rs. 8,000 crore is performance-based grants for incubation of new cities and Rs. 450 crore is for shared municipal services.
  12. The Commission has recommended imposing entry-level conditions for local bodies to receive grants. These include
    1. setting up of State Finance Commissions in States, act upon their recommendations and lay the explanatory memorandum as to the action taken thereon before the State legislature on or before March 2024
    2. having both provisional and audited accounts online in the public domain
    3. fixation of minimum floor for property tax rates by the relevant State followed by consistent improvement in the collection of property taxes in tandem with the growth rate of State's own GSDP (for urban local bodies).
  13. The Commission has recommended that 60 per cent of the grants to rural local bodies and for urban local bodies in non-Million-Plus cities should be tied to supporting and strengthening the delivery of two categories of basic services:
    1. sanitation, maintenance of ODF status (for Rural Local Bodies), solid waste management and attainment of star ratings as developed by MoHUA (for non-million plus cities / Category-II Cities/Towns;
    2. drinking water, rain water harvesting and water recycling (both for Rural Local Bodies and Urban Local Bodies).
  14. The Commission has recommended that for cities with million plus population (Million-Plus cities), 100 per cent of the grants are performance-linked through the Million-Plus Cities Challenge Fund (MCF).
  15. The Commission has recommended that a sum of Rs. 8,000 crore is recommended to States as grants for incubation of new cities and Rs. 450 crore for facilitating shared municipal services.
  16. The detailed recommendations of the Commission related to local bodies grants are contained in Chapter 7 of Volume–I of the Final Report.
  17. The Government has accepted the above recommendations of the Commission.
    Disaster-related Grants- State Disaster Risk Management Fund (SDRMF) and the National Disaster Risk Management Fund (NDRMF)
  18. The Commission has recommended the continuation of the existing cost sharing ratio between the Union and State Governments of 75:25 for general states and 90:10 for North-East and Himalayan States. The Commission has recommended allocation of disaster management funds to SDRMFs should be based on factors of past expenditure, area, population, and disaster risk index (which reflect States' institutional capacity, risk exposure, and hazard and vulnerability respectively). Assuming an annual increase of 5 per cent, the Commission recommends the total corpus of Rs.1,60,153 crore for States for disaster management for the duration of 2021-26, of which the Union share is Rs. 1,22,601 crore and States share is Rs. 37,552 crore.
  19. The Commission has recommended that the total States allocation for SDRMF should be sub-divided into funding windows that encompass the full disaster management cycle. Thus, the SDRF (State Disaster Response Fund) should get 80 per cent of the total allocation and the SDMF (State Disaster Management Fund) 20 per cent. The SDRF allocation of 80 per cent to be further distributed as 40 per cent for Response and Relief, 30 per cent for Recovery and Reconstruction and 10 percent for Preparedness and Capacity-building. While the funding windows of the SDRF and SDMF are not interchangeable, there could be flexibility for re-allocation within the three sub-windows of SDRF.
  20. The Commission has recommended that the allocation for the National Disaster Risk Management Fund (NDRMF) should be based on expenditure in previous years. Assuming an annual increase of 5 per cent, the total national allocation for disaster management is estimated to be Rs. 68,463 crore for the duration of 2021-26.
  21. The Commission has earmarked allocations under NDRMF. The Commission has recommended that NDRF(National Disaster Response Fund) should get 80 per cent of the total allocation for the NDRMF, with further division into 40 per cent for Response and Relief, 30 per cent for Recovery and Reconstruction and 10 per cent for Preparedness and Capacity-building. The National Disaster Mitigation Fund (NDMF) should be allotted 20 per cent of the total allocation for the NDRMF. If required, the Ministry of Home Affairs may examine the need for amending the Disaster Management Act to create three sub-windows within the NDRF. While the funding window of NDRF and NDMF should be maintained, there could be flexibility for re-allocation within these sub-windows.
  22. The Commission has recommended that all Central assistance through the NDRF and NDMF should be provided on a graded cost-sharing basis. States should contribute 10 per cent for assistance up to Rs. 250 crore, 20 per cent for assistance up to Rs. 500 crore and 25 per cent for all assistance exceeding Rs. 500 crore.
    The Government has accepted these recommendations of the Commission.
    Grants to States for Specific Sectors.
  23. The Commission has recommended providing grants to State Governments in eight different sectors, namely health, school education, higher education, agriculture, maintenance of PMGSY roads, aspirational districts and blocks, judiciary, statistics. The Commission has recommended providing grants to these sectors amounting to Rs.1,29,987 cr during the five year period of the award period.
  24. The details of the sectoral grants for health to be provided through State Governments are contained in paras 9.52 to 9.67 of Chapter 9 of Volume-I of the Final Report. The details of these sectoral grants are contained in paras 10.31 to 10.92 of Chapter 10 of Volume-I of the Final Report.
    Government will give due consideration to sectors identified by the Commission while formulating and implementing existing and new Centrally Sponsored and Central Sector Schemes.
    State Specific Grants.
  25. The Commission has recommended State Specific Grants amounting to Rs.49,599 cr over the award period of the Commission. These recommendations are contained in paras 10.117 to 10.125 including Table 10.11 and Annexes 10.9 and 10.10 in Chapter 10 of Volume-I of the Final Report
  26. Keeping in view the untied resources with the State Governments and the fiscal commitments of the Central Government, due consideration will be given to the above recommendation.
    Modernization Fund for Defence and Internal Security (MFDIS)
  27. The Commission has recommended to constitute in the Public Account of India, a dedicated non-lapsable fund, Modernisation Fund for Defence and Internal Security (MFDIS), to bridge the gap between projected budgetary requirements and budget allocation for defence and internal security. Total indicative size of the proposed MFDIS over the five-year period to be Rs. 2,38,354 crore. Of this amount the Commission has recommended that a total of Rs. 1,53,354 cr shall be transferred to the MFDIS from the Consolidated Fund of India over the award period of the Commission. The details of the said Fund, its constitution etc are contained in Chapter 11 of Volume-I of the Final Report.
  28. The Government has accepted in-principle the creation of non-lapsable fund for Defence in the Public Account of India. Sources of funding and modalities will be examined in due course.
    Fiscal Roadmap
  29. The Commission has recommended that the normal limit for net borrowings of State Governments may be fixed at 4 per cent of GSDP in 2021-22, 3.5 per cent in 2022-23 and be maintained at 3 per cent of GSDP from 2023-24 to 2025-26. The Commission has also recommended an extra annual borrowing space for the States, of 0.50 per cent of their GSDP for the period 2021-22 to 2024-25, based on performance criteria in the power sector.
  30. The Commission has recommended that the FRBM Act needs a major restructuring and recommend that the time-table for defining and achieving debt sustainability may be examined by a High-powered Inter-governmental Group. This High-powered Group can craft the new FRBM framework and oversee its implementation. It is important that the Union and State Governments amend their FRBM Acts, based on the recommendations of the Group, so as to ensure that their legislations are consistent with the fiscal sustainability framework put in place.
  31. The Government accepts in-principle, the recommendations in respect of the quantum (as a per cent of GSDP) of net borrowing ceilings for the States. Other recommendations related to the fiscal road map for the States and amendments to the FRBM Act will be examined separately.
    Other recommendations
  32. In addition to the above, the Commission has made other recommendations. These relate to resource mobilization (Chapter 5 of Volume-I of the Final Report), fiscal consolidation for States and the conditionalities associated with the same (Chapter 12 and 13 of Volume-I of the Final Report), performance-based incentives and grants (Chapter 10 of Volume-I of the Final Report) etc.
  33. The Government will examine these recommendations of the Commission in due course.
    Implementation
  34. Orders on the accepted recommendations under Article 270 and 275(1) of the Constitution relating to share in Union Taxes and duties and Grants-in-aid respectively will be issued after obtaining the approval of the President. The recommendations related to fiscal path, borrowing limits of the States and Other recommendations of the Commission will be acted upon in due course.

Administrative sanction

Author's note:

In issuing the below order ie. G.O.Ms.No.18,Dated:26-03-2021, the Telangana government has empowred the Grmapanchats to work as independant and self government. The Garm Panchayats are empwered to accord Administrative saction unlimited amount and no need obtaion any kind of sanction from the out side authority, to take up developmental works.

In this regard it may be noted that as per sub-section(2) of Section 73 of Telangana Panchayat Raj Act, 2018, it is mandatory to the gram panchayat, that,the budget shall be sent to Mancda Panchayat Officer(erstwhile E.O.PR&RD) for scruitiny and suggestions.

But in the above orders, at para 1, grovernment has stated, that annual Budget be submitted, to the Divisional Panchayat Officer, for approval, which is contrary to Section mentioned above

Further it is also mentioned that the administration sanction accorded is subject to approval of Gram Sabha. In said section the buget so prepared by grampanchayats should have to be placed before Gram Sabha, for prioritization and aproval and it is mandatory to Grampanchayats to sanction the budget,as it is, without any modifactions to such budget. In case, the Gram Sabh doesn't approves the work taken up by the grampanchayat for any reason, what will the be fate of administrative sanction given by grampanchayat.

O R D E R :

In the G.O. 1st read above, orders were issued that the Major Gram Panchayats shall accord administrative sanction to Civil works upto Rs.2,00,000/- and Minor Gram Panchayats shall accord administrative sanction upto Rs.1,00,000/-. For Civil Works costing over and above Rs.1,00,000/- in Minor / Major Gram Panchayats, but upto Rs.3,00.000/- the administrative sanction shall be issued by the Divisional Panchayat Officer; and that over and above Rs.3,00,000/- administrative sanction shall be issued only by the District Collector. These powers applicable to all works under all grants. It is also ordered that all the Gram Panchayats should call for the Grama Sabhas, priorities the works and prepare annual budgets and submit them to the Divisional Panchayat Officers for approval. The Gram Panchayats should not take up works over and above the financial viability of respective Gram Panchayats.

The Commissioner, Panchayat Raj & Rural Employment, Hyderabad in the letter 2nd read above has stated that, as per the New Telangana Panchayat Raj Act, 2018, the Panchayats are empowered to spend the grants available with them, without reference to any other statutory authority and requested to issue necessary orders.

In the circumstances reported by the Commissioner, Panchayat Raj & Rural Employment, Hyderabad, in supersession to the orders issued in the G.O. 1st read above and after careful examination of the matter permission is hereby accorded as follows:-

  1. The Grama Panchayat is empowered to accord administrative sanction for works irrespective of the amount, subject to approval of Gram Sabha.
  2. The cumulative sum of Administrative sanction issued must be limited to the actual funds available during the current financial year.
  3. The execution, measurement and technical aspects of the works shall be as per the applicable norms of the Panchayat Raj Engineering Department.

The Commissioner, Panchayat Raj & Rural Development, Hyderabad is requested to take necessary action accordingly.

This order shall be applicable to each District with immediate effect, except Nalgonda District. This order shall be applicable to Nalgonda District after the completion of election in the District.

O R D E R:-

In view of the ensuing rainy season and the seasonal diseases like gastroenteritis, diarrhoea, dengue, chikungunya, malaria, typhoid and viral fevers amidst the ongoing Covid-19 pandemic, there is every need to take utmost care and adequate precautionary and preventive measures to prevent the spreading of these diseases and safeguard public health in the rural areas of the state.

2. The following guidelines are issued to all the Gram Panchayats in the State to take up preventive and precautionary measures to safeguard public health within their jurisdictions.

1.  Measures to prevent stagnant water within the Habitations:
The Sarpanch and the Panchayat Secretary along with the Sanitation Sub-Committee of the Gram Panchayat shall take up a scheduled and structured Padayatra of all the Habitations of the Gram Panchayat to identify those areas where there is a likelihood of the water stagnation/water pools during the ensuing rainy season. The Sarpanch and the Panchayat Secretary shall ensure that immediate and time bound steps are taken to prevent such stagnation. The following areas need to be attended to:
1.1  Desilting of all pucca and kaccha drains before and during the rainy season so as to ensure the free flow of drain water and rain water.
1.2   Ensuring the filling up with good quality "morom" of all low-lying areas to prevent rain water/waste water from gathering and creating water pools.
1.3  Filling up all pot-holes on main roads and path ways in the village. Any form of water stagnation on the roads should be prevented.
1.4  Ensure that rain water drains away from the village by clearing all channels/kalvas for free flow of the water to the nearest kunta or tank.
1.5  After every rain, the Sarpanch and the Panchayat Secretary should visit all wards and check for any stagnant water pools and take measures to drain away the collected water and prevent such stagnation in the future.
1.6  Expeditious completion of household, institutional and community soak pits.
1.7  The measures to prevent stagnant water should cover not only the habitation, but all public institutions of in the village like schools, hospitals, market yards, aangan wadis, etc.

Government have from time to time initiated several reforms in tendering for Public works with a view to bring in simplification of procedures, greater transparency and to ensure better quality of works.

2. Government issued orders in the G.O 2ndread above introducing comprehensive reforms streamlining and standardising the procedures for calling tenders and award of contracts.

3. Government issued ordars in the G.O. 3rd read above, ordering further tender reforms with a view to curb collusion and unfair practicess adopted by the Contractors in the tendering process.

4. Aftar isauance of the aforesaid orders, cornplaints were received by the Government that the Contractors were still indulglng in unfair practices and colluding in filing the tenders. Government, therefore, with a view to take stringent action in such cases, convened a workshop on 10-11-1996, with the representatives of Builders Association, Contractors and Government Officials to elicit their vieves on furthar reforms required to be introduced. The Committee constituted with the represantatives of the Builders Association and Government Officials, after thorough examination of the consensus emerged in the workshop has made certain recommendations to Govemment.
